정신 art commission terms of service

By ordering a commission from me, 정신, you affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission without a refund, or a blacklist announcement. Please note that these Terms of Service may be subject to change without prior notice.What are the differences between personal and commercial use commissions?The artwork will not earn any profit if it is used for personal purposes. Printing for personal use (not for resale) and using it as a wallpaper/avatar on non-profit sites (Deviantart, Toyhouse, Twitter, Instagram, etc.) are examples of personal use.Commercial use is defined as any use that has the potential to create revenue, solicit customers, or has a direct or indirect financial gain, such as using the artwork for your brand (marketing materials, business objectives, etc) or profit-generating social media platforms (Twitch/Youtube/etc).Commission of first priorityIf you wish to skip the waitlist and get your commissions done by a certain date, you can book a priority commission. The priority fee is up to 50% of the base price.

I am willing to draw any of the following:

•Human(oid) | Kemonomimi | Anthro (Anthros that lean heavily towards the feral side instead of human(oid) will be rejected)•Original Characters and/ or Fan Characters•Sonas•Fanart•NSFW•Original characters/Custom designs•Implied Sexual ContentAny couple type of any sexuality
This includes but is not limited to:•Canon x Canon•Canon x OC•OC x OC•Male x Female•Male x Male•Female x Female

I will not draw any of the following:

•Feral•Gore•Mecha•Sexualized underage characters (in actual age and appearance)•Pedophilic relations•Incestuous relations

General:

•You are only purchasing my services and the digital file. Not printed art•I own the Artwork, so I may do whatever I wish with the art, for example; Post it to other sites such as Instagram, Twitter and Patreon. Or present it in future art books/ Portfolios etc. But always with proper credit to you!•You may re-post an image from me with proper credit and do not claim it as your art!•You can use your commissioned art as decoration for your social media as long as it's a personal account and you're NOT making any profit from it. ( If you want to profit from it it will be discussed via email )•I will send you the full resolution picture (by email or through a google drive link), but my Signature will remain on it somewhere small.•I reserve the rights of canceling/decline your order If I don't feel comfortable drawing it or you have been proved troublesome in any way.•You are free to print out the commission or even make whatever merchandising you want as long as it's for your PERSONAL use only and NOT for sale.

The following cases are considered commercial useReproducing and selling the artwork

•If you want to order an illustration for commercial use it will be 50%-100% higher than the price of the commission you ordered.•When you receive profit in the Media where you're using it and /or as a way to get attention ( like Youtube videos, credit cards, banner of personal site, games, streams, etc. ) credit me for the artwork!•DO NOT ask me to draw in a different style. If you commission me, it's because you like my work, not because your favorite artist is busy. Even if the provided reference of your character has a color palette section, I'll probably modify them a little bit to make them fit in my style. (Just a slight change don't worry!) However, if you want me to stick to them, please specify it in the form. The 'Other Details' section is there for such wishes.•By purchasing any of my services you are automatically accepting my terms of service and being obligated to follow them. As well as promising you won't harm any of these rules.Violates will be added to my blacklist without any warnings.
Either temporary or permanent.

About Ordering and Payment

•References must be clear and full in color. However description commission is also possible but it counts as character design, therefore an additional fee to pay. Pictures such as photos or screenshots from game characters are OK however, the result will look like my anime art style.•After sending your order to me and discussing the price I will send an invoice through PayPal to you. I will receive full payment before starting the commission. The high-quality files will be sent to you via google drive link or email once it's finished.•Payment must be made within 48 hours unless otherwise stated. If payment is not made in a timely manner, the commission will be canceled on the spot and you will be put back on the waiting list.•If your character is extremely detailed, I have the right to charge extra. This will be stated before you send the payment. You may switch out the character if you do not want to pay for detailed charges.•If a commissioner repeatedly commissions me but in the end always canceling the order, I will consider you a time-waster and blacklist you.•It is okay for you to upload watermarked versions to personal picture albums such as Photobucket, Weebly, toyhou.se, etc, but please credit me as ''정신" or ''dgetenesu'' in the title/description of the upload.

Refund Rules

•I can refund 100% of the payment ONLY If I have not started working on the sketch.•I will only refund you have a reasonable excuse.•Not Started: 100% Refund•Sketch: 50% Refund + Sketch is sent
•Line Art: partial refund ( will be treated as ''Ink commission'')•Completed Art: NO REFUNDS

Deadline

•You may set a deadline if you wish but it must be reasonable. The maximum time I need to finish a digital commission could take up to 2 weeks to 2 months depending on how busy I am.•If you need your finished piece quickly and wish for your commission to be PRIORITY, there will be an option to purchase a rush fee depending on how fast you want it to be done.

Communication

•I am not in charge of sending WIPs unless asked for or I feel the need to.•Rude/disrespectful/abusive commissioners will have their commission immediately canceled with a refund based on how much of the artwork was completed already.•I expect you to be polite and kind when you're ordering a Commission! And be sure I'll be polite and kind as well!•If you would like to see a WIP (work in progress) of your commission please don't hesitate to ask.•There is no limit per order for extra WIPs. But please consider that it costs me extra time to pause work and wait for your feedback.. so please don't ask for 100+ wips.•The sketch phase is your chance to tell me what you want to be changed: expressions, details, pose, etc. Please don't be shy if something really doesn't sit well with you. I do my best to capture the character's personality but sometimes I do make mistakes, especially if it wasn't clear from the order.

Changes In Your Commission

•Once the picture is finished I can do small changes such as color adjustments and/or adding tiny details I may have forgotten.•I will only make changes to the final piece if it was an error on my part (i.e. I missed a detail that you had provided in the order).•If it's a change you want and I did not have clear, obvious information when you ordered the art, I will not make the changes unless additional fees are paid (exact amount to be determined, depending on the scale of the change).•Any great changes will come with an extra charge such as poses, outfit change, outfit addition or subtraction, background change, or anything that makes me have to redraw it completely.•The responsibility is on you to ensure your order contains the details you want me to follow. I will not redraw commissions unless payment is sent for a second order.•If your reference was unclear to start with, then you are not allowed to do minor changes without a fee. Make sure to be clear in your order what you aim for.
